RULES FOR THE PURCHASE AND SALE OF GOODS
1. General provisions
1.1. These rules of the e-shop (hereinafter referred to as the Rules) are legally binding document for the Buyer and the Seller (hereinafter referred to as the Seller), which sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer shall be informed about the changes in the Rules on the website of the e-shop.
2. Conclusion of the contract of sale
2.1. The Purchase-Sale Agreement between the Buyer and the Seller shall be deemed to be concluded when the Buyer forms and places an order for goods in the e-shop, having previously familiarized with these rules.
3. Seller rights
3.1. In the event of important circumstances, the Seller may temporarily or completely suspend the operation of the e-shop without prior notice to the Buyer.
3.2. If the Buyer tries to harm the operation, stability and security of the e-shop or violates its obligations, the Seller has the right to restrict or suspend his/her access to the e-shop without notice.
4. Seller's obligations
4.1. The Seller undertakes to provide the possibility to use the services of the e-shop, the conditions of operation of which are determined by these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the method of delivery chosen by the Buyer on the basis of the terms and conditions set forth by these Purchase and Sale Rules.
4.3. When, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the e-shop, the Seller has the right to terminate the Purchase-Sale Agreement after informing the Buyer. The seller can offer an analogous product. If the Buyer refuses, the Seller undertakes to return the money paid within 3 working days.
4.4. If the Buyer exercises the right provided for in clause 5.2. of the Rules, the Seller undertakes to return the money paid to the Buyer within 5 (five) business days from the date of receipt of the returned goods.
4.5. The Seller may not refund the amount of money paid by the Buyer until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, depending on what happens first.
5. Buyer's rights
5.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the contract for the purchase and sale of goods concluded in the e-shop by notifying the Seller thereof in writing not later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer’s right, as discussed in clause 5.2, may be exercised by the Buyer only if the product has not been damaged or has not substantially changed its appearance, as well as if it has not been used.
6. Buyer's obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules.
6.2. If the Buyer, at the time of delivery of the goods, refuses to accept the goods without important reasons, the Buyer shall, at the request of the Seller, bear the costs of returning the goods.
6.3. At the time of delivery of the goods to the Buyer, the Buyer together with the Seller or with the person who delivered the consignment must check the condition of the consignment and the goods(s).
6.4. By using the e-shop, the Buyer confirms that he/she agrees with these purchase and sale rules and must comply with them.
7. Prices of goods
7.1. The prices of the goods in the e-shop are indicated in euros. After confirming the order, the delivery fee contributes to the total amount of goods, if any.
8. Ordering and payment of goods
8.1. When the Buyer visits the e-shop, selects the goods he like, which he adds to the shopping cart. After the formation of the shopping cart, the Buyer enters the personal data necessary for the execution of the order: his name, surname, address at which the goods will be delivered, the telephone number and additional information, which may be important when delivering the ordered goods. The Buyer confirms that he/she has read these rules and confirms the order.
8.3. Payment is available using Swed, Seb, Luminor bank e-banking services, and Visa/MasterCard payment cards. Payments are possible in the euro currency.
9. Delivery of goods
9.1. When ordering goods, the Buyer must indicate the exact delivery address of the goods.
9.2. The buyer must accept the goods himself. If the Buyer is unable to accept the goods himself, but the goods are delivered to the address indicated by the Buyer, the Buyer has no right to make claims regarding the delivered goods to the wrong person.
9.3. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods.
9.4. The characteristics of all goods sold are indicated in the description next to each item. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the e-shop may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer withdraws from the contract of purchase and sale of the goods, the Buyer shall be refunded all the amounts paid by him, including the cost of delivery of the goods paid by the Buyer.
10. Return of goods
10.1. Quality goods can be returned within 14 days from the date of receipt. Weaknesses of defective goods sold are eliminated, defective goods are replaced, returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning the goods, the following conditions must be met:
10.2.1. The returned item must be in the original orderly packaging (this item does not apply in the case of return of a defective item);
10.2.2. The product must be undamaged by the Buyer;
10.2.3. The item must not be used without loss of marketable appearance: undamaged labels, unspoilt protective films, etc. (this item does not apply in the case of return of a defective item);
10.2.4. The returned item must be of the same set as it was received by the Buyer (this item does not apply in the case of the return of a defective item);
10.2.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods have not been met;
10.2.6. The return of the goods shall be carried out in the manner established by the Seller within 14 (fourteen) days from the date of receipt of the goods (this point does not apply in the case of defective - in this case the return of the goods within the statutory warranty period is carried out);
10.3. The return and replacement of goods of appropriate quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code;
10.4. The money paid for the goods accepted by the Buyer, but later refused, shall be returned to the Buyer’s account not later than within 5 (five) days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.
10.5. Mari Made Flowers blouses are made on an individual order, so they are not refundable when buying online based on the exception provided for in Article 6.228 (10) of the Civil Code.
10.6. Mari Made phone cases are custom-made, so when buying online, based on the exception provided for in Article 6.228 (10) of the Civil Code, they are non-refundable.
11. Final provisions
11.1. These Rules are made in accordance with the legal acts of the Republic of Lithuania.
11.2. These Rules and relations between the Parties shall be applied and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disagreements arising from the implementation of these Rules shall be resolved by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be exempted from the fulfilment of their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force major).
12. Warranty period
12.1. Warranty period - 3 months.
